1. Terms

These Terms of Service (“Terms” or “Agreement”) govern the relationship between you and ERTECH YAZILIM VE BİLGİ TEKNOLOJİLERİ LİMİTED ŞİRKETİ (ERTECH SOFTWARE) (“ERTECH SOFTWARE,” “we,” “our,” or “us”), including its subsidiaries, parent companies, joint ventures, affiliates, and their respective agents, consultants, employees, officers, and directors. These Terms apply to your access and use of www.ertechsoftware.com and all related mobile applications, websites, and services offered by ERTECH SOFTWARE, including but not limited to services available via the Apple App Store, Google Play Store, Amazon App Store, and Facebook (collectively, the “Services”).

Please read these Terms and our Privacy Policy carefully before using the Services. By installing, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree to all of these Terms, please do not use the Services. The Services are licensed, not sold, to you, and your use of the Services is void where prohibited by law.

All content within the Services, including software, text, images, and trademarks, is owned by ERTECH SOFTWARE or its licensors. You have no ownership interest in any content or virtual items obtained through the Services.

4.2. User Content

By submitting content (such as posts, comments, or images) through the Services, you grant ERTECH SOFTWARE a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and distribute that content. ERTECH SOFTWARE may monitor user content and reserves the right to remove or disable access to inappropriate content without notice.

You may purchase virtual items within the Services. These items are licensed to you on a limited, non-transferable basis. ERTECH SOFTWARE reserves the right to modify or remove virtual items at any time without compensation.

5.2. Refunds

All purchases made through the Services are final. ERTECH SOFTWARE does not provide refunds or exchanges, and you are responsible for any unauthorized charges made to your account.

10. Limitation of Liability

ERTECH SOFTWARE will not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. ERTECH SOFTWARE’s liability to you will not exceed the amount you have paid to ERTECH SOFTWARE in the past six months.

11. Indemnity

You agree to indemnify and hold ERTECH SOFTWARE harmless from any claims, damages, or expenses arising from your violation of these Terms.

12. Dispute Resolution

Any disputes between you and ERTECH SOFTWARE will be resolved in accordance with the laws of Turkey, with jurisdiction in Istanbul courts.

13. No Class Actions

You may only bring claims against ERTECH SOFTWARE on an individual basis and not as part of a class action.

14. Severability

If any part of these Terms is found to be unenforceable, the remaining provisions will remain in full force.

15. Assignment

ERTECH SOFTWARE may assign these Terms to any third party without notice. You may not assign your rights without ERTECH SOFTWARE’s consent.

16. Entire Agreement

These Terms constitute the entire agreement between you and ERTECH SOFTWARE regarding the Services.

17. Equitable Remedies

ERTECH SOFTWARE may seek injunctive relief if you violate these Terms and cause irreparable harm to the Services.

18. Force Majeure

ERTECH SOFTWARE is not liable for any failure to perform due to unforeseen events such as natural disasters or governmental actions.
